80 influencers and representatives attended raffle and promotional training on social networks by Colombian gaming regulator

(Bogota).- Currently, a draft decree is being processed through which it seeks to increase the number of raffles allowed, to go from one annually to four monthly, for a total of 48 raffles each year. A total of 80 content creators, representatives of influencers and members of gambling guilds attended the three days of training on raffles and promotions on social networks organized by Coljuegos.

“This is a space that we open to induce and guide them to know the law, since the illegal raffles that are being carried out on social networks can have consequences for citizens,” said the president of Coljuegos, Marco Emilio Hincapié.

During the sessions held on April 4, 11 and 18, Coljuegos officials explained that digital influencers who wish to promote goods or services, commercial establishments, companies or entities, in which prizes are offered to the public, must enter the site Coljuegos website, fill out the application form and pay the respective exploitation rights.

Likewise, those who promote raffles must request the respective authorization from the jurisdiction in which the game operates. That is, if the raffle is held in a municipality, the authority is the Mayor's Office; If it is carried out in more than one municipality, it is the responsibility of the departments through lotteries; and if it is national (more than two departments) the authorization is processed before Coljuegos.

It is worth mentioning that the exploitation rights for the raffles correspond to 14% of the total number of tickets issued, plus an additional 1% of said value for administration expenses. Likewise, in the case of promotional prizes, the exploitation rights correspond to 14% of the total prizes paid, plus an additional 1% of said value for administration expenses.

Those who carry out raffles and promotions through social networks, without having the respective authorization and without paying exploitation rights, incur a violation of article 312 of the Penal Code, which refers to the illicit exercise of monopolistic activity of the rentistic arbitrage.

In the same sense, those who violate the rule may receive fines of up to 100 current legal monthly minimum wages, and sanctions such as inability to operate games of luck and chance for five years, blocking from carrying out new promotional campaigns, among others.

Influencers who are interested in obtaining more information can visit the Coljuegos headquarters, located at Carrera 11 #93A-85, from 8:00 in the morning to 5:00 in the afternoon.
